A ban on children changing gender in school is facing potential delays until after the election, causing concerns among Tory MPs. There are growing fears that Rishi Sunak will postpone the implementation of new trans rules to avoid a damaging civil war within the Conservative Party.

Guidance for Teachers Delayed

The much-anticipated guidance for teachers, originally scheduled to be published in July, was unexpectedly pulled at the last minute. Government lawyers advised that a proposed block on pupils identifying as the opposite sex would require fresh legislation.

Concerns of a Postponement

It was widely expected that the new rules would be included in the Prime Minister's annual agenda at November's King's Speech. However, Tory MPs are now worried that it could be delayed as ministers strive to prevent party divisions leading up to the election.

Some backbenchers are calling for a halt on children transitioning, while others prefer a more lenient approach. The debate has caused work on the trans rules to pause over the summer, with insiders suggesting that No10 is stalling on the issue.

Time Constraints and Potential Amendments

With an election approaching next year, time is running out to pass any new legislation through Parliament. There are concerns that backbenchers may attempt to amend the legislation to push their own views on gender.

Call for Clarity

Nadhim Zahawi, former Education Secretary, emphasized the need for sensible guidance for schools, stating that both parents and teachers require support. He highlighted that social transitioning is not a neutral action and that the well-being of children is at risk without proper protections and support.

Jonathan Gullis, ex-schools minister, echoed these sentiments and urged ministers to provide clear guidance with legislation. He stated that the current situation is causing distress for teachers, parents, and pupils, asserting that the government has a responsibility to address the issue promptly.

Education Department's Response

Responding to the concerns, a spokesperson for the Education Department stated that due to the complexity and sensitivity of the issue, they are taking the necessary time to ensure that the guidance provided is clear. They emphasized the importance of biological sex and advised schools and colleges to proceed with caution, prioritizing the safeguarding and well-being of all children and involving parents in decisions relating to their child.
