Demands for 'nuclear option' to revoke court decisions

A new book by academic Dr Michael Arnheim claims that "woke" judges in the UK are over-interpreting the country's international commitments when it comes to asylum-seekers and migrants. According to Arnheim, this has led to a situation where politically correct judge-made law undermines the authority of Parliament. He argues that it is time for Members of Parliament to have the power to revoke any decision made by a British court, including the Supreme Court.

Call for volunteers to patrol the channel and turn back small boats

In addition to the "nuclear option" proposal, Arnheim suggests creating a volunteer force to patrol the English Channel and prevent small boats from reaching British waters. He compares this force to the fictional "Dad's Army" and recommends that they work in cooperation with the Navy. This, he believes, would help address the ongoing issue of illegal migration.

Judicial interpretation and its impact on human rights law

Arnheim's book, titled "Fixing Human Rights Law," argues that the UK is currently being governed not by the rule of law, but by the rule of lawyers and judges. He claims that this approach contradicts the sovereignty of Parliament and undermines the principle of parliamentary legislative supremacy. Arnheim asserts that woke lawyers and judges have exacerbated issues such as the immigration crisis, disruptive protests, and ruinous strikes.

According to Arnheim, a proper reading of Article 3 of the European Convention on Human Rights demonstrates that the UK and other signatory states are only responsible for the treatment of individuals "within their [own] jurisdiction." He warns that unless judges are reined in, the backlog of asylum cases will continue to grow.

Arnheim concludes that the lack of clarity, predictability, and accessibility in the UK's legal system is evidence of the absence of the rule of law. He believes that reestablishing the sovereignty of Parliament and limiting the power of judges is crucial for maintaining democracy in the country.
